Trademark Registration and Protection

A trademark is a sign used to distinguish the goods or services of one business from those of others. Trademarks may consist of words, logos, symbols, images, or combinations of these elements and form the basis of a company’s brand identity.

The most common types of trademarks include:

  • word marks (names, words, slogans);

  • figurative marks (logos, graphic elements);

  • combined marks (a combination of words and visual elements).

Trademark protection arises after the mark is registered with the competent patent office. Trademark certificate usually  is valid for 10 years and may be renewed indefinitely for further ten-year periods.

The scope of trademark protection depends on the sign itself and the list of goods and services for which it is registered according to the Nice Classification.


Requirements for trademark registration

To be registered, a trademark must:

  • be distinctive and capable of identifying the origin of goods or services;

  • not be identical or confusingly similar to earlier registered or applied trademarks for similar goods or services;

  • not consist solely of descriptive or generic elements;

  • not violate public order, morality, or restrictions established by law.
