Revocation of the Moratorium on the Running of Procedural Deadlines in the Field of Intellectual Property in Ukraine

 

From today, Law of Ukraine No. 4362-IX comes into force, which repeals the law “On the Protection of the Interests of Individuals in the Field of Intellectual Property during the Martial Law Introduced in Connection with the Armed Aggression of the Russian Federation against Ukraine.

 

As a result, the moratorium on the running of deadlines for procedures related to the protection of intellectual property rights is canceled. This moratorium was introduced in 2022 because of the full-scale armed aggression of the Russian Federation against Ukraine and was in effect from February 24, 2022, to May 31, 2025.

 

According to the law, the running of procedural deadlines is resumed from the date of entry into force, taking into account the time that had elapsed before their suspension, but for no less than 75 days, i.e., until August 14, 2025, inclusive.

 

In this regard, owners and applicants in the field of intellectual property should carry out as soon as possible all actions postponed due to the war in order not to lose their rights. This applies to applications submitted for:

  • trademarks,
  • industrial designs,
  • inventions and utility models,
  • geographical indications,
  • plant varieties,
  • layouts of semiconductor products,
  • as well as already registered rights to these objects.

Therefore, it is necessary to pay the relevant fees in a timely manner and to submit applications, responses, objections, and other required documents by the specified date.

 

Further extension or renewal of missed deadlines is not provided for by law.
